Mass Tort Intake Process – A Walkthrough of Your First Call with NGRV 

At Nigh Goldenberg Raso & Vaughn, we understand that Mass Tort litigation can be complex and the process to start a lawsuit may seem complicated. Many people are unsure of what to expect, what information they may need or if they have a qualifying case. Discover how the Mass Tort Intake process works at NGRV.

What Does the Intake Team Do?  

When you contact Nigh Goldenberg to begin your lawsuit, you will first relate to the firm’s Intake team. The Intake team is responsible for assisting clients through the initial case evaluation phase, which includes gathering information necessary for the attorney to assess the strength of a lawsuit and the potentially applicable statute of limitations. Case consultation is always free of charge and you will not be charged for any legal services unless a successful resolution is reached.  
 
Let’s walk through the steps of your first contact with our Intake team, whether through phone call or email. 

Step One: Meeting the Client  

Our Intake specialist will begin by confirming your basic information:  

  • Name and contact information 
  • Date of birth 
  • Current address or state of residence 
  • Preferred method of contact  
     

Step Two: Learning Your Story 

Next, our Intake specialist will ask you questions about your experiences and why you are looking to pursue a claim. Depending on what kind of claim you qualify for, you may be asked to provide: 

  • Medications or proof of drug usage. If you know where you filled your prescriptions, our team can request your pharmacy records.  
  • Products purchased or proof of usage. Receipts and reward cards can help prove you purchased an item.  
  • Medical devices implanted. Some medical devices come with a card identifying the brand-name of the medical device and manufacturer. Other times patients have no idea what was implanted in them and our team has to order medical records to determine what device was implanted,  
  • Dates of exposure or use. Being able to give approximate dates assist our legal team in assessing causation and various potentially relevant laws. 
  • Diagnosis and medical treatment dates. As with dates of exposure, diagnosis received and approximate dates of treatment are needed for our legal team to assess the strength of your claim both legally and medically.   
  • Medical and treatment history. In order to preliminarily assess potential alternative causation and the extent of damages, our legal team typically requests a brief medical and treatment history. 

 

Step Three: Evaluation of Your Case  

Once your intake form is complete, your information will be sent to the NGRV Intake Attorney for review. During this phase, the Intake Attorney will review your intake information and: 

  • Ensure your case meets firm set criteria 
  • Decide on whether we will accept your case for further investigation 

 

Step Four: Complete Your Sign-Up  

If we accept your case, you will receive documents explaining the attorney-client relationshipcontingency fee arrangement, and an authorization form that is necessary to obtain relevant medical records. Feel free to ask the Intake Team if you have any questions or concerns about the documents or the mass tort process. 

 

Step Five: What Happens Next? 

Once your case is fully signed up, your case will be sent to the designated litigation team, who will be in contact with you within a few weeks. Your case is now in the investigation phase. During the case investigation phase, your assigned litigation and medical record ordering team will work with you directly to secure all relevant documents and records related to your case. Moving forward, your designated litigation team will be the best point of contact for all communications concerning your case.  

 

Intake Checklist: What Should You Have Available Before Your Call?  

  • Legal name and date of birth 
  • Contact information and current address 
  • Approximate dates of product use or exposure  
  • Approximate dates a medical device was implanted and/or removed  
  • Approximate dates of injuries, symptoms, diagnosis, and treatment 
  • Facility where treatment was received 
  • Approximate date you learned you may have a potential claim 

 

If you don’t have all of the above information on your first call, that’s okay, we can get the information as it becomes available.
